These Terms and Conditions govern all photography services provided by Salifa Magnan Photography (the Photographer). By booking a session, you (the Client) confirm that you have read, understood, and agreed to these Terms in full. These Terms form a binding agreement between the Photographer and the Client.
1. Services, Scope, and Deliverables
1.1 Session Details
The specific session type, package, location, date, time, and any add-ons applicable to each booking are agreed upon individually with each Client during the booking process. These Terms and Conditions apply to all session types and bookings offered by the Photographer.
1.2 Scope & Additional Requests
The agreed session scope is defined at the time of booking. Any requests made on the day that fall outside the agreed scope will be subject to an additional fee agreed upon before proceeding. The Photographer reserves the right to decline requests that fall outside the original brief.
1.3 Editing Style
The Photographer’s editing style is an integral part of the service and the brand. The Client acknowledges that they are booking the Photographer for their unique aesthetic. Re-edits or requests to alter the Photographer’s editing style are not offered or accepted. Images will not be delivered unedited unless the Client has requested and paid for the raw files option (see Section 5.2).
2. Booking and Payment
2.1 Booking Fee
A non-refundable Booking Fee of 50% of the total session fee is required to confirm and secure the booking. No date or time slot is held until the Booking Fee has been received. By paying the Booking Fee, the Client confirms their agreement to these Terms and Conditions in full.
2.2 Remaining Balance
The remaining balance is due in full upon completion of the session. The gallery and all deliverables will be withheld until full payment has been received, as outlined in Section 2.4.
2.3 Accepted Currencies & Payment Methods
The main payment currency is Euros (EUR), however US Dollars (USD) and Seychelles Rupees (SCR) are also accepted, subject to applicable exchange rates at the time of payment. Payments are accepted via bank transfer, cash, or PayPal. Any bank, transfer, or transaction fees incurred in the process of payment are the sole responsibility of the Client.
2.4 Late or Non-Payment
In the event that the remaining balance is not received upon completion of the session, the Client’s gallery and all deliverables will be withheld until payment is made in full. Invoices not settled within 7 days of the session completion date will incur a late payment surcharge of 5% of the outstanding balance for every 7 days the invoice remains unpaid thereafter. The Photographer reserves the right to pursue outstanding balances through appropriate legal channels if necessary.
2.5 Disputed Invoice
If the Client believes there is an error on their invoice, they must contact the Photographer in writing at salifamagnan@gmail.com within 48 hours of receiving it. Disputes raised after this window may not be considered.
3. Cancellation and Rescheduling
3.1 Cancellation by the Client
The Booking Fee secures the time and services of the Photographer and is non-refundable and non-transferable in the event of cancellation. This represents the agreed loss suffered by the Photographer as a result of the cancellation.
Cancellation less than 48 hours before the scheduled session will result in the full session fee becoming payable immediately.
All cancellations must be made in writing (email or WhatsApp message). Verbal cancellations will not be accepted.
3.2 Wedding Postponements
In the event that a wedding is postponed to a later date, the Booking Fee will be retained and applied to the new date, provided the Photographer is available and able to reschedule. If the Photographer is unavailable for the new date, the Booking Fee will be forfeited.
3.3 Rescheduling by the Client
Clients may reschedule their session once at no additional charge, provided a minimum of 7 days’ written notice is given prior to the original session date. Rescheduling is subject to the Photographer’s availability.
Rescheduling requests made within 7 days of the original session date will be subject to a rescheduling fee, to be confirmed in writing by the Photographer at the time of the request.
3.4 Cancellation by the Photographer
In the event that the Photographer is unable to fulfil the booking due to illness, personal emergency, or circumstances beyond their control, the Photographer will make every reasonable effort to reschedule the session to a mutually convenient date. In such cases, the Booking Fee will be retained and applied to the rescheduled date. The Photographer’s liability in these circumstances is limited to rescheduling only.
4. Gallery Delivery
4.1 Turnaround Time
Portrait, couples, family, maternity, and solo sessions: 3 to 7 working days.
Wedding sessions, elopement, and event sessions: up to 3 weeks.
Turnaround times may be extended during peak season. The Photographer will communicate any delays in advance.
4.2 Delivery Method
All final edited images are delivered via a private online gallery link. Images are provided at both full resolution (suitable for printing) and web-optimised resolution (suitable for social media and digital use). The gallery link will be sent to the email address or contact provided at the time of booking.
4.3 Gallery Storage
Client galleries are stored and backed up for a period of 6 months following delivery. After this period, the Photographer is under no obligation to retain or restore the images. It is the Client’s sole responsibility to download and back up their images within the 6-month storage period following gallery delivery. The Photographer cannot be held responsible for images not downloaded within this period.
5. Copyright and Image Rights
5.1 Ownership
The Photographer retains full copyright ownership of all images produced during the session/event at all times. The purchase of a photography session grants the Client a personal, non-commercial licence to use the delivered images for personal use only (printing, sharing, social media). This licence does not transfer copyright to the Client.
5.2 Raw/Unedited Files
Unedited raw files remain the sole property of the Photographer and will not be delivered as standard. If the Client wishes to obtain the raw and unedited photographs, a fee of €350 applies. This fee accounts for the time, resources, and creative responsibility that come with providing photographs outside of the Photographer’s finished standard. The purchase of raw files does not transfer copyright ownership to the Client. The Photographer reserves the right to decline this request at their discretion.
5.3 Photographer’s Right to Publish
Unless the Client has submitted a written privacy request prior to the session, the Photographer reserves the right to use any images produced during the session for the following purposes:
- Portfolio display on the Photographer’s website
- Social media platforms, including but not limited to Instagram, Facebook, TikTok, and Pinterest
- Photography competition submissions
- Promotional and marketing material
Clients who wish for their gallery to remain private, either permanently or for a specified period, must submit a written request via email to the Photographer before the session takes place. The Client must clearly state whether the request is permanent or temporary, and if temporary, specify the desired hold period. The Photographer will confirm all approved privacy requests in writing. Upon expiry of an agreed temporary hold, the Photographer reserves the right to publish the images in accordance with these Terms.
Privacy requests made after the session or after the gallery has been delivered will not be honoured.
The Client’s use of the delivered images on their own social media or public platforms does not constitute a waiver of these rights by the Photographer.
5.4 Sharing with Collaborators
The Photographer may also share selected images with third-party vendors who contributed to the session or event, including but not limited to planners, venues, florists, stylists, makeup artists, and other service providers, for their portfolio and marketing use.
Vendors receiving images:
- Must credit the Photographer in all publications
- May not alter, edit, or apply filters to the images
- May not sell or redistribute the images
- May use the images for promotional purposes only
No entire gallery will be shared with third-party vendors without prior written consent from the Client.
6. Videography & Video Content
6.1 Nature of Video Services
Video capture is not a primary service offered by the Photographer and is not advertised as such. Where video content is captured during a session, it is provided as a supplementary offering at the Photographer’s discretion and subject to the Client’s prior consent. The Photographer does not represent themselves as a professional videographer.
6.2 Unedited Footage
Where video is captured using a phone or action camera during the session, unedited footage may be shared with the Client as a keepsake at no additional cost, subject to the Photographer’s discretion and the Client’s consent at the time of the session. Unedited footage is shared as-is, and the Photographer makes no guarantees regarding quality, continuity, or coverage.
6.3 Edited Reels & Highlight Videos
Clients who wish to receive an edited reel or highlight video, including drone footage compilations, may request this service at an additional cost to be agreed upon in writing prior to the session. Pricing, turnaround time, and deliverables will be outlined in the individual client contract.
6.4 Drone Footage
Where drone footage is captured during a session, the Photographer retains full ownership of all drone video content. The Photographer reserves the right to repurpose, edit, and use drone footage in future promotional content, social media, and portfolio material, subject to the same privacy terms outlined in Section 5.3.
6.5 Photographer’s Video Rights
The Photographer may capture behind-the-scenes video content during the session using any device, subject to the Client’s consent as outlined in Section 6.1, for use on social media and promotional platforms. This content remains the sole property of the Photographer and is subject to the same privacy request process outlined in Section 5.3. Clients who have submitted a privacy request will have this extended to all video content captured during their session.
7. Limitations of Liability
7.1 Equipment Failure & Unforeseen Circumstances
In the event of equipment failure, accidental data loss, illness, or any other circumstances beyond the Photographer’s reasonable control that result in the partial or complete loss of images, the Photographer’s liability is strictly limited to a refund of the session fee paid or the rescheduling of the session. No further compensation, damages, or claims will be entertained beyond this limit.
7.2 Personal Injury & Property Damage
The Photographer is not liable for any personal injury, loss, or damage to property that may occur during the session, including but not limited to injury sustained at the session location. Clients attend sessions at their own risk.
7.3 Weather & Environmental Conditions
The Photographer cannot guarantee specific lighting conditions, weather, or environmental factors. Sessions affected by poor weather may be rescheduled at the Photographer’s reasonable discretion, subject to Section 3.3.
8. Client Conduct
The Photographer is committed to providing a positive, safe, and professional experience for all Clients. The Photographer reserves the right to terminate a session immediately and without refund if:
- A Client’s behaviour is deemed by the Photographer to be aggressive, abusive, inappropriate, or threatening
- A Client’s behaviour creates an unsafe environment for the Photographer or any third parties present
- A Client makes requests that conflict with the Photographer’s professional ethics or these Terms
In such circumstances, the full session fee will remain due and payable, and the Booking Fee will not be refunded. No images will be delivered.
9. Governing Law & Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Seychelles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Seychelles.
By proceeding with a booking, the Client confirms that they have read, understood, and accepted these Terms and Conditions in their entirety. It is the Client’s responsibility to read these Terms, regardless of the channel through which the booking was made. These Terms are available at all times at www.salifamagnan.com
